Lenz & Staehelin defended Sunrise Communications

Lenz & Staehelin defended Sunrise Communications, a fully owned subsidiary of Sunrise Communications Group, against an application for interim injunctions filed by Salt Mobile. The dispute arose out of an exclusivity agreement concluded by the parties in connection with a potential joint venture. Salt’s application was based on alleged breach by Sunrise in the context of a public tender offer by UPC Schweiz for all Sunrise shares. After an oral hearing, the Commercial Court of the Canton of Zurich did not find a breach of the exclusivity agreement and fully rejected Salt’s application.
