Lalive with Lupaka Gold Corp in arbitration win against Peru

Lalive represent Canadian mining company Lupaka Gold Corp. in ICSID successful arbitration proceedings against the Republic of Peru.

The context

Marking the first decision of this kind for Latin America, the tribunal held that the actions of a local community, including the blockade and seizure of the Invicta gold project, were attributable to the State. Peru was found to have breached its obligations under the Canada-Peru FTA and was ordered to pay the full amount claimed in the arbitration plus interest and full costs – total value USD 65M+.
