Homburger represents Nestlé Nespresso in its patent infringement lawsuits
K-Fee System has sued Nestlé Nespresso for infringement of three European patents. K-Fee belongs to the Krüger group of companies. The group has recently partnered with Coca-Cola in the coffee pod business with the production of pods that are compatible with the classic Nespresso system.
On May 11, 2023, the Swiss Federal Patent Court handed down a judgement confirming that Nespresso’s Vertuo coffee capsules do not infringe the patents EP 3 023 362, EP 3 521 207 and EP 3 521 209. The patent owner may appeal the judgement to the Swiss Federal Supreme Court.
Homburger acted as sole Swiss representative of Nespresso in this matter. The team was led by partner Andri Hess (pictured) and included associate Angelika Murer (both IP/IT, litigation).
