Kellerhals Carrard successfully represented FNAC

Kellerhals Carrard successfully represented FNAC (Suisse) SA in its appeal against a decision issued by the City of Geneva to exclude FNAC Suisse (SA) from its “Bons d’achat solidaires” scheme (indirect support from the City of Geneva to businesses affected by the consequences of the COVID-19 pandemic).

After participating in the first stage of the scheme, FNAC (Suisse) SA was then excluded on the grounds that it belonged to a foreign group of companies. In its decision ATA/183/2021 dated 23 February 2021, the Administrative Chamber of the Court of Justice of the Canton of Geneva found that such exclusion constituted a violation of FNAC (Suisse) SA’s economic freedom (protected by the Swiss Constitution) and ordered the City of Geneva to immediately reinstate FNAC (Suisse) SA as a participant in the scheme.
