Pestalozzi with a state gas company in a high-value ICC gas arbitration dispute

Pestalozzi was part of a team of international law firms that successfully represented a state gas company in a high-value ICC gas arbitration dispute arising out of gas supply contracts signed in the mid-90s. The final arbitral award rendered in June 2020 was a tremendous success for the state gas company. The counterparty initiated proceedings with the Swiss Federal Supreme Court to set-aside the final arbitral award. In its judgment rendered in February 2021, the Swiss Federal Supreme Court rejected the counterparty’s challenge of the award in its entirety, essentially following the state gas company’s position as laid out in its briefs to the Swiss Federal Supreme Court.
