NKF advises Microsoft on public clouds contract with Swiss Confederation

Niederer Kraft Frey has advised Microsoft Schweiz with regard to the Public Clouds Contract concluded on 27 September 2022 with the Swiss Federation and assisted in the negotiations.

With the “Public Clouds Confederation” project, the Federal Administration can obtain highly scalable cloud services from five major providers. Representatives of the Federal Administration and the five providers have concluded the corresponding contracts. Basic documents are also available to the public.

The contracts with the five cloud providers of “Public Clouds Bund” have been signed. The providers have signed a framework agreement with identical content. In addition, additional contract components were worked out with each provider. A legal contract analysis ensured that the providers provide comparable services. The Federal Chancellery is currently examining the extent to which the contracts can be published.

The NKF team was led by technology partner Clara-Ann Gordon (pictured), working with associate Binderiya Gan-Ayush (technology) and senior associate Annina Fey (procurement law/real estate).
